Modifier 95 as it Relates to Medicare Part B and COVID-19 Billing

Modifier 95 Defined: Synchronous telemedicine service rendered via real-time interactive audio and video telecommunications system.

During the COVID-19 PHE, and through CY 2023 the modifier 95 should be used when a real-time interaction between the provider at the distant site and the patient at an originating site occurs via an audio or an audio and video telecommunications system. It should be appended to all services as indicated on CMS’ List of Telehealth Services. This list consists of CMS’ approved telehealth services and are the only codes modifier 95 should be appended to.

Other services such as e-visits (services provided via online patient portals or email) are not defined as telehealth services because the audio or audio and video component was not utilized. Therefore, modifier 95 should not be appended to services such as these.
