Medicare Overpayments Are Not Redeterminations
Our records indicate some providers are incorrectly submitting redetermination request forms for MSP overpayment issues.
Please use this notification as educational instruction from National Government Services and refrain from using the redetermination process for MSP overpayments.
If you find that Medicare paid as the primary, but should be secondary payer, please follow the steps below:
- Based on your jurisdiction, complete the Medicare Secondary Payer Post-Pay Overpayment Form, include signatures and do not leave anything blank. You may pull the J6 or JK form from the following:
- Attach a copy of the primary explanation of benefits.
- Mail or fax to the number listed at the bottom of the form.

Note: Providers should not contact the BCRC to set up new MSP records. Instead, report MSP coding on your MSP and conditional claims. Providers should not contact the BCRC to correct MSP records to make Medicare primary. Instead, report coding on your primary claims to indicate why Medicare is primary. If there is no applicable coding, you may refer beneficiaries and other entities to the BCRC.
